Recent public commentary by political figures — both in Western Canada and in Ontario — has been disturbing, as it appears to call into question the independence of the judiciary. While concerning, these moments also present an important opportunity: to educate and reinforce the foundational principles that underpin our democracy.

Once again, we must stress that independent courts are essential to the rule of law. Judges must render decisions based solely on the facts and the law before them — not on external pressures, public opinion, or the expectations of those in authority.  As Chief Justice Geoffrey Morawetz of Ontario recently stated, it would be “inappropriate and unethical for judges to succumb to outside pressure to modify or qualify their decisions or reasons.”

When trusted public officials publicly criticize judicial decisions or suggest consequences — such as resource implications — it risks creating misunderstanding about the role of judges and may give rise to perceptions of political figures trying to influence our work.

Within our mandate to protect judicial independence and promote public understanding, the Association is actively working to respond. Our committees — including those focused on judicial independence and public education — are advancing a range of initiatives to support this effort. These include:
