The CSCJA Board of Directors convened in Montreal, Quebec, on November 15, 2025, as usual. The central focus of our meeting this year was to determine the Association’s action in response to the government’s rejection of the Quadrennial Commission’s recommendations 

Following an extensive discussion informed by expert legal opinion, and the views of colleagues from across Canada, the Board adopted a strategy emphasizing the defense of the constitutional integrity of the compensation process. 

As communicated to all members in the email from the President on December 3, 2025, the Board resolved to proceed with the application for judicial review of the government’s decision on the Quadrennial Commission’s report. This was filed with the Federal Court on December 3, 2025. See the complete, bilingual application.

This action addresses the widely held view that the government’s response was unprincipled, notably for failing to meaningfully engage with the Quadrennial Commission’s primary justification for a raise: the private sector salary comparator data. 

Recognizing the highly sensitive nature of the matter, the Board retained professional communications counsel to ensure that any public communication will be factual, responsible, and consistent with the principles of judicial independence. 

An official statement with backgrounder has been developed to educate the media and public on the critical role of the Quadrennial Commission in ensuring the separation of powers and to underline the importance and constitutional obligation of meaningful engagement by government.
